By using the Vento VPN Services and/or accessing the Vento VPN Website, you fully agree to all of the terms provided herein, as well as the terms and conditions of the Vento VPN Privacy Policy. If you do not agree to be bound by the terms and conditions contained herein, you are prohibited from accessing the Vento VPN Website and/or its services.

1. Vento VPN Services

Vento VPN encrypts your internet traffic and hides your IP address and physical location. It allows you to route your internet traffic through servers in different countries, making it appear as if you are browsing from those locations. The Service includes both free VPN services and optional premium services, such as purchasing individual IP addresses, dedicated VPN nodes, or other value-added features through in-app purchases. Free VPN services are provided free of charge with access to available VPN resources, subject to service availability and operational conditions.

Premium services are subject to the terms applicable to the purchased service. Premium IP services are provided based on available network resources. Due to factors including network conditions, third-party providers, security requirements, or operational needs, IP addresses or nodes may be changed, replaced, or temporarily unavailable.

2. Prohibited and Restricted Uses

Except as otherwise set forth in this Agreement, you may not use the Site, Services, or Content to:

• Send or transmit unsolicited advertising or Content (i.e., "spam") through the Services.
• Send, post, or transmit through the Services any Content that is unlawful, hateful, threatening, abusive, defamatory, infringing of intellectual property rights, invasive of privacy, or inciting violence.
• Upload, download, post, reproduce, or distribute any Content that is protected by copyright or any other proprietary right without first obtaining the permission of the owner of the proprietary Content.
• Upload, download, post, reproduce, or distribute any content that contains sexual or explicit depictions of minors.
• Engage in any conduct that restricts or inhibits any other user from using or enjoying the Services.
• Attempt to access, probe, or connect to computing devices without proper authorization (i.e., any form of "hacking").
• Use the Service for automated connections (bots) or any form of automated data scraping.
• Use the Service for any purpose other than its lawful purpose, including but not limited to illegal activities, copyright infringement, or any activity that violates applicable laws or regulations.

3. Ownership

All materials contained on or made available through the Application or Website (including all information, data, text, sound, graphics, and video information), as well as all source code, application compilations, and other materials ("Materials"), are copyrighted and owned or licensed by Vento VPN. All rights are reserved.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Materials without our prior written consent.

4. In-App Purchases and Premium Services

4.1 Premium Services

Certain features of the Services may be offered as paid in-app purchases ("Premium Services"), including but not limited to individual IP addresses, dedicated VPN nodes, or other premium network services.

By purchasing Premium Services, you agree that:

• All purchases are processed through the applicable app marketplace, such as Google Play Billing or Apple App Store.
• Prices, available Premium Services, and applicable taxes may vary by region and are subject to change without prior notice.
• Access to Premium Services is granted only after successful payment confirmation.
• Premium Services are provided only for the purchased period or under the purchased conditions, where applicable.
• You are responsible for complying with all applicable laws and regulations when using Premium Services.
• Vento VPN does not guarantee that any specific IP address or Premium Service will be accepted by any third-party website, platform, or service. Availability and usability may vary depending on external factors beyond our reasonable control.

You may not resell, sublicense, lease, or redistribute purchased IP services or Premium Services to any third party without our prior written authorization.

4.2 Refund Policy

Unless otherwise required by applicable law, all purchases are final.

Refund requests for purchases made through Google Play or Apple App Store are subject to the refund policies of the applicable platform.

Vento VPN cannot directly process refunds for purchases completed through third-party app stores.

If Premium Services cannot be provided due to technical issues caused solely by Vento VPN, we may, at our sole discretion, provide reasonable compensation or assist users in contacting the applicable payment platform.

By completing a purchase, you acknowledge and agree that Premium Services may become available immediately after payment confirmation. Where permitted by applicable law, you may lose the right to cancel or request a refund after the service has been activated or used.

5. Termination

We reserve the right to refuse service, suspend accounts, or restrict access to the Services in our sole discretion without any explanation or notice, particularly in cases of violation of this Agreement.

This Agreement will terminate immediately if you breach any of your obligations under this Agreement.

You may terminate your relationship with us at any time by completely uninstalling the Application and ceasing to use the Services. Upon termination, you shall cease all use of the Services and the Application.

6. Disclaimer

We strive to improve the accuracy of the Services, but complex software can never be completely free of defects or errors. We do not guarantee that the Services will meet your requirements or that they will be uninterrupted, timely, secure, or error-free. You acknowledge that access to the Site and the Service is at your sole risk.

You agree that the Service is provided on an "as is" and "as available" basis and that use of the Site and the Service is entirely at your own risk. You understand and agree that any materials and/or data downloaded or otherwise obtained through the use of the Service are done so at your sole discretion and risk, and that any damage or loss of data that results from the download of such materials and/or data is your sole responsibility. Unless otherwise stated, we make no warranty whatsoever with respect to any goods or services purchased or obtained through the Services or any transactions entered into through the Services.

We are not responsible for lost, undelivered, delayed, or misdirected data, information, or pages due to interruptions or performance problems with the Services, communication services, or networks.

We do not warrant that the Services are compatible with all devices, operating systems, or network environments. It is your responsibility to ensure that your use of the Services complies with all applicable local laws and regulations.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Vento VPN or any other party involved in the creation, production, distribution, promotion, or marketing of the Service be liable to you or any other party for any special, indirect, incidental, exemplary, or consequential damages, including, but not limited to, damages for loss of data or profits, or the inability to use the Service, even if Vento VPN or such other party has been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for all claims arising out of or relating to this Agreement or the Services exceed the greater of (a) the amount paid by you for the Services (if any) or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Vento VPN, its officers, directors, employees, members, partners, agents, and suppliers, and their respective affiliates, officers, directors, employees, members, shareholders, partners, and agents, from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Content and Services, any violation of this Agreement by you, or any infringement or violation of any rights of another person or entity by you.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.

9. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Vento VPN operates, without regard to its conflict of law principles.

Any dispute arising out of or relating to this Agreement or the Services shall first be attempted to be resolved through informal negotiation between the parties. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of a recognized arbitration body. The arbitration shall be conducted in English, and the arbitration award shall be final and binding on both parties.

You agree that any claim or cause of action arising out of or related to this Agreement or the Services must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

10. Miscellaneous

10.1 Entire Agreement. This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Vento VPN regarding the Services and supersedes all prior agreements and understandings.

10.2 Severability. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

10.3 Waiver. No failure or delay by Vento VPN in exercising any right under this Agreement shall constitute a waiver of that right.

10.4 Assignment. You may not assign this Agreement or any rights or obligations hereunder without our prior written consent. We may assign this Agreement freely without restriction.

10.5 No Agency. Nothing in this Agreement shall be construed as creating an agency, partnership, joint venture, or employment relationship between you and Vento VPN.

11. Modifications to This Agreement

We reserve the right to modify and update these Terms at any time and for any reason in our sole discretion and without liability. We will make reasonable efforts to notify you of material changes through the Services or by other means. Your continued use of the Services after any such changes constitutes your acceptance of the updated Terms.

We also reserve the right to modify or update the operation of the Service at any time and for any reason without notice or liability.
